Definitions

For the purposes of these Pre-Order Terms and Conditions (“POT&C”):

  • “Prota Designs,” “we,” “us,” or “our” means Prota Designs.
  • “Customer,” “you,” or “your” refers to any individual, company, or entity placing a Pre-Order with us.
  • “Pre-Order” refers to a purchase agreement for products still in development, not yet manufactured, or ready to ship. This type of campaign is sometimes also referred to as a “group buy” or “GB.”
  • “Website” refers to protadesigns.com and any related Shopify-hosted store pages.

Acceptance

By placing a Pre-Order on our Website, you agree to these POT&C. These terms take effect on the date you complete your order and payment (the “Pre-Order Date”).

Prices and Payment

  • Prices shown at checkout are valid at the time of purchase but may change without notice for future orders.
  • All payments must be made in U.S. dollars ($USD) through Shopify at the time of checkout.
  • Customers paying with international cards may be subject to currency conversion fees or bank charges. Prota Designs is not responsible for exchange rate fluctuations or additional charges from your payment provider.
  • If a product is mistakenly listed at an incorrect price, we reserve the right to cancel any orders placed at that price, even if payment has been processed. If this occurs, we will notify you and issue a refund.
  • We may set order or credit limits and reserve the right to refuse or limit sales at our discretion.

Pre-Order Policy, Cancellations, and Changes

  • Pre-Orders are eligible for cancellation and refund if the order has not yet shipped. This allows us to manage production effectively and ensure successful completion. Once shipped, cancellations are no longer possible, but you may return the product for a refund. Please confirm compatibility and product details before purchasing to avoid unnecessary returns.
  • If you make changes to your order after the Pre-Order Date (such as product configuration or shipping address), you may be subject to updated pricing or additional fees.
  • Any modifications made by the customer (e.g., changes to the product’s structure, functionality, or appearance) render the product ineligible for return, refund, or product support. Once modified, we will not offer product support or warranty for the item.
  • If your shipping address is entered incorrectly or not updated before your order ships, you will be responsible for:
    • A $10 return surcharge, and
    • A second shipping fee to resend the order.

Agreement to Purchase

By placing a Pre-Order, you agree to purchase the product(s) described in your order configuration at the stated price. Delivery will be completed once production is finished and the product is ready to ship.

Title and Risk of Loss

Ownership of products remains with Prota Designs until payment is received in full. Risk of loss or damage passes to the customer once the order has been handed over to the shipping carrier.

Delivery

  • Estimated shipping times are listed on the product page but are subject to change depending on production schedules.
  • We reserve the right to decline delivery to any customer at our sole discretion.

General

  • These POT&C apply specifically to Pre-Orders and take precedence over other Terms and Conditions on our Website where there is a conflict.
  • If any part of these POT&C is found to be invalid or unenforceable, the remaining provisions will continue in effect.
  • Our decision not to enforce a part of these POT&C in a given instance does not waive our right to enforce them in the future.
